Terms of Service

1. Who we are

BidsScores ("BidsScores," "we," "us") is a product of Restored Technology LLC. These Terms of Service ("Terms") form an agreement between you and Restored Technology LLC governing your use of the BidsScores website and application (the "Service").

2. Acceptance

By accessing or using the Service, creating an account, or using a beta access code, you agree to these Terms and to our Privacy Policy and Disclaimer. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization.

3. Nature of the Service

The Service evaluates contractor bids and produces scores, comparisons, and a recommendation and report to support your decision-making. As explained in our Disclaimer, output is advisory and informational only, is not professional advice, and does not make procurement decisions for you. You are solely responsible for your decisions and their outcomes.

4. Accounts, beta access, and device limits

• You must provide accurate information and keep your credentials and any beta access code confidential. You are responsible for activity under your account.
• Beta access is temporary, may be revoked at any time, and does not create a paid subscription or any guarantee of continued access.
• To protect against credential sharing, the Service limits the number of devices per account. Sharing login credentials is prohibited.

5. Your content

You retain ownership of the bids, documents, and information you upload ("Your Content"). You grant us a limited license to host, process, and analyze Your Content solely to provide and improve the Service. You represent that you have the right to upload Your Content and that doing so does not violate any law or third-party right.

6. Acceptable use

You agree not to:

• upload content you are not authorized to share, or that is unlawful or infringing;
• reverse engineer, scrape, or attempt to circumvent access, device, or usage limits;
• resell or provide the Service to third parties except as expressly permitted; or
• use the Service to build a competing product or to misrepresent its output as a certified appraisal or professional opinion.

7. Payment

Paid plans are billed through our payment processor (Stripe) according to the plan you select. Fees are stated at checkout. Unless required by law or stated otherwise, fees are non-refundable. We may change pricing prospectively with notice.

8. Intellectual property

The Service, including its software, scoring methodology, and branding, is owned by Restored Technology LLC and protected by law. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service; no other rights are granted.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that results will be accurate or complete. See our Disclaimer.

10. Limitation of liability

To the maximum extent permitted by law, Restored Technology LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or procurement losses, arising out of or related to your use of the Service. Our total liability for any claim will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim or US $100.

11. Indemnification

You agree to indemnify and hold harmless Restored Technology LLC from claims arising out of Your Content, your use of the Service, or your violation of these Terms or applicable law.

12. Termination

We may suspend or terminate access at any time for violation of these Terms or to protect the Service. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.

13. Changes

We may update these Terms. Material changes will be reflected by the "Last updated" date above; continued use after changes means you accept them.

14. Governing law & contact
